Muhammad U. winning his case at Administrative Appeals Tribunal

𝐂𝐨𝐧𝐠𝐫𝐚𝐭𝐮𝐥𝐚𝐭𝐢𝐨𝐧𝐬 𝐌𝐮𝐡𝐚𝐦𝐦𝐚𝐝 𝐔. 𝐨𝐧 𝐰𝐢𝐧𝐧𝐢𝐧𝐠 𝐡𝐢𝐬 𝐜𝐚𝐬𝐞 𝐚𝐭 𝐭𝐡𝐞 𝐀𝐝𝐦𝐢𝐧𝐢𝐬𝐭𝐫𝐚𝐭𝐢𝐯𝐞 𝐀𝐩𝐩𝐞𝐚𝐥𝐬 𝐓𝐫𝐢𝐛𝐮𝐧𝐚𝐥!

Muhammad came to Australia in March 2020 to study Bachelor of Information Technology at a reputed university in Sydney. Unfortunately, things did not go as per his expectations and as a result, he downgraded his study level and enrolled in a Diploma course, and changed to study at different colleges. Muhammad did not complete any of his studies in Australia for the last 3.5 years due to different reasons.

In October 2022, the Department canceled Muhammad’s student visa due to a breach of condition 8202 (not enrolling in a registered course at the same AQF level). He quickly engaged with our migration team for assistance in lodging his AAT application.

After carefully examining Muhammad’s circumstances, we prepared a strong submission with supporting documents for him. Our team also supported U to get a bridging visa so he could stay lawfully in Australia.

Although it has been a year full of struggles, including being involved in some legal matters that impacted Muhammad’s study progress and personal life, finally, we have won the case. On 22 November 2023, the visa cancellation decision was set aside by the AAT.

Muhammad burst into tears when he heard about his winning. He felt very fortunate that he could continue his studies in Australia and achieve his dream.

We wish Muhammad all the best with his study in Australia and we hope that he will be able to become a successful software developer in the near future.

In addition, over the time, Afzaal came to realise that he was interested in becoming a community worker. For this reason, he came to see our education counsellor and was advised to enrol in the Bachelor of Community Services at Stotts College. This program has received accreditation from the Australian Community Workers Association (ACWA).

From September 2, 2023, to January 31, 2024, only individuals who currently hold a COVID-19 Pandemic event visa are eligible to apply for a new COVID-19 Pandemic event visa.

Please note that starting from February 1, 2024, the COVID-19 Pandemic event visa program will no longer accept applications.

If you submit your application on or after September 2, 2023:

You will be required to pay a Visa Application Charge (VAC). Additional charges apply for each family member applying for the visa with you.
If your application is approved, your visa will permit a stay in Australia for a maximum of six months.

For those who applied before September 2, 2023, if your application is approved, your visa will allow a stay in Australia for up to 12 months (or up to 2 years for TGV holders). 📅🇦🇺
