Expanding pathways to PR for temporary skilled sponsored workers

From 25, November 2023* (subject to the approval of regulation changes), the Australian Government will be making changes to the Temporary Skill Shortage (TSS) (subclass 482) and

Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme (ENS) (subclass 186) visas to provide a simpler and clearer pathway to permanent residence for TSS visa holders.

The changes will provide employers and holders of TSS visas with more certainty and ensure Australia attracts and retains the skilled workers it needs.โ€‹

Temporary Skill Shortage (subclass 482)

From 25 November 2023* the Government plans to remove the limit on the number of Short-term stream TSS visa applications that visa holders can make in Australia.

This change is intended to apply to new TSS visa applications made on or after 25 November 2023. Short term-stream TSS holders with visas expiring before 25 November 2023 will need to travel outside Australia to lodge a third short term-stream TSS application.

Employer Nomination Scheme (subclass 186) Temporary Residence Transition Stream

Changes planned for TRT stream nomination requirements include:

  • allowing employers to nominate holders of all streams of TSS visas (including Short-term and Labour Agreement streams).
  • removing the requirement for nominated occupations for the TRT stream to be assessed against a skilled migration occupation list. The nominated occupation will need to be listed in the Australian and New Zealand Standard Classification of Occupations (ANZSCO) and the nominated worker will need to continue to work in the occupation nominated for their TSS visa(s).
  • reducing the period of time a TSS visa holder must hold their visa and work in their nominated position or occupation to be eligible to be nominated by their employer for the TRT stream to two out of the three years before nomination.

Changes to the TRT stream nomination requirements are intended to apply toย newย ENS and Regional Sponsored Migration Scheme nomination applications and applications that areย yet to be finally determinedย as at 25 November 2023*.

Changes planned for TRT stream visa application requirements include:

  • updating age exemptions for regional medical practitioner applicants and high income earning applicants aged 45 years and over to allow for a two-year pathway.
  • ending COVID-19 related age exemptions that will become redundant as a result of the two-year pathway.

These changes are the first step in providing more equitable access to PR for all TSS visa holders whilst the government continues work on reforms to the skilled visa programs following the development of theย Outline of the Governmentโ€™s Migration Strategyย and in response to the findings of theย Review of the Migration System 2023.

PR Pathways for existing skilled workers on TSS 482 Visa short term stream

TSS Visa to Permanent Residencyย 

The Department of Home Affairs has setโ€ฏ25 November 2023โ€ฏfor implementing changes to the employer-sponsored permanent residency program.ย 

Once the ENS reforms have been implemented, short-termโ€ฏTemporary Skill Shortage (TSS) 482 Visaโ€ฏholders will gain access to permanent residency under the 186 Temporary Residence Transition Stream (TRTS)โ€ฏof the ENS visa program.ย 

  • Allโ€ฏTemporary Skill Shortageย (TSS) SC 482 visa holders will be eligible for ENS visas sponsored by their employers.ย 
  • Applicants will need to continue to work in the occupation nominated for their TSS visa(s).ย 
  • Sponsored visa holders will be eligible for ENS TRT afterโ€ฏtwo yearsโ€ฏ(down from three years) of sponsorship on a TSS by their employer.ย 
  • Applicants will need to meet all other nomination and visa requirements for the TRT stream of the Employer Nomination Scheme visa.ย 
  • Theโ€ฏlimitโ€ฏon Short Term stream TSS visa applications that can be made onshore has also beenโ€ฏremovedโ€ฏin the interim.ย 

ย 

PR pathway for specified 482/457 Visa STSOL holdersย 

From 1 July 2022 applicants can apply for permanent residency if they are:ย 

457 visa holders:ย 

  • (1) A person who on 18 April 2017 held a subclass 457 visa or had a pending 457 visa application that was subsequently grantedย 

482 visa holders:ย 

  • (2) Commencing 1 July 2022 if you are a subclass 482 holder andย 
  • if you have been in Australia for at least 12 months between 1 February 2020 and 14 December 2021; andย 
  • at the time of application, you are employed by an employer actively and lawfully operating a business in Australia.ย 

โ€ฏย 

This new legislation provides a pathway to permanent residency for Subclass 482 visa holders in the short-term stream, regardless of whether their nominated occupation is on the Medium & Long-Term Strategic Skills List (MLTSSL), the Short-Term Skilled Occupation List (STSOL) or the Regional Occupation List (ROL).ย 

This new legislation is relevant for applications under the following Employer-sponsored programs:ย 

 

According to the changes, if the applicants have worked for their employer for two of the last three years while holding a 482 visa in the short-term stream, after 1 July 2022, they can apply for 186 permanent residency visas.ย 

Legislative Instrumentโ€ฏMigration (Specified persons and periods of time for regulation 5.19) Instrument (LIN 22/038) 2022โ€ฏreplacesโ€ฏIMMI18/052โ€ฏwhich was self-repealed on 18 March 2022.ย 

This new Instrument provides a pathway to employer sponsored permanent residency for an additional cohort of SC457/482 visa holders through the Temporary Residence Transition stream of the employer nominated/sponsored schemes as announced by Minister Hawke on 25 November 2021.ย 

After 30 June 2022 a new cohort of โ€˜specified personsโ€™ will be eligible to be nominated under the TRT stream of the SC 186 and in some cases the RSMSSC 187.ย

UPDATE THE SKILLED NOMINATED VISA PROGRAM FOR VICTORIA 2023-2024.

The Skilled Visa Nomination Program in the state of Victoria for the year 2023 – 2024 (SUBCLASS 190 & SUBCLASS 491) has officially commenced. To be considered for nomination by the state, you are required to submit an Expression of Interest (EOI) application.

Candidates residing in the state of Victoria, as well as those living overseas, should submit their EOI after reviewing the eligibility criteria for:

  • Skilled Nominated Visa (subclass 190)
  • Skilled Work Regional Visa (subclass 491)

Expression of Interest (EOI) Application Process

To apply for nomination for a Victoria state visa, you need to submit an Expression of Interest (EOI) and be invited by the state. The information you provide in your Expression of Interest on the SkillSelect platform will be used in the assessment of your EOI application.

Consequently, you may be required to answer some questions in your EOI application. Therefore, it is important to keep your information updated in your Expression of Interest, including your current place of residence.

What is the Skilled Nominated Visa (SUBCLASS 190)?

This is a permanent visa for skilled migrants. You must receive a nomination from the state of Victoria before applying for this visa. If you are in Australia, you must be living in Victoria at the time of nomination.

Eligibility Criteria

To be eligible to apply for the Skilled Nominated Visa (SUBCLASS 190) nomination in Victoria, you must:

  • Commit to living in Victoria.
  • Have your Expression of Interest (EOI) selected.
  • Be under 45 years of age.
  • Be proficient in English.
  • Have a valid skills assessment for an occupation on the eligible skilled occupation list for this visa type.
  • Score a minimum of 65 points in the Australian government’s points test for your Expression of Interest (EOI) in SkillSelect.

What is the Skilled Work Regional Visa (SUBCLASS 491)?

The Skilled Work Regional Visa (SUBCLASS 491) allows skilled migrants to live, study, and work in designated areas for up to 5 years, with a pathway to permanent residency.

You must receive a nomination from the state of Victoria before you can apply for this visa. After 3 years, individuals with a 491 visa may be eligible to apply for a 191 visa for permanent residency.

Eligibility Criteria

To be eligible to apply for the Skilled Work Regional Visa (SUBCLASS 491) nomination in Victoria, you must:

  • Commit to living in a regional area of Victoria.
  • Have your Expression of Interest (EOI) selected.
  • Be under 45 years of age.
  • Be proficient in English.
  • Have a valid skills assessment for an occupation on the eligible skilled occupation list for this visa type.
  • If you are in Australia, you must be living and working in a regional area of Victoria at the time of nomination. Please note that some outer suburbs of Melbourne are included in the regional area of Victoria by the Department of Home Affairs.
  • Commit to living and working in a regional area of Victoria.
  • Score a minimum of 65 points in the Australian government’s points test for your Expression of Interest (EOI) in SkillSelect.
