CONGRATULATIONS TO NGUYEN THANH HAI FOR OBTAINING A STUDENT VISA (SUBCLASS 500) – JUST ONE WEEK AFTER SUBMITTING THE APPLICATION

> His application was a quite complicated case:

– Biometrics and health check were scheduled on February 2, and the school starts on February 6.

– From a high-risk area

– Difficulties in proving work experience and weak financial proof

– No English proficiency, planning to take the PTE exam for a 462 visa, still required to complete a 20-week English course upon submission

– Graduated in one major, with work experience in another field, but still wants to pursue the major they studied despite graduating many years ago.

Hai was very worried about his application and feared that it would be difficult to obtain a student visa. After discussing with him, the team convinced him to follow the best possible plan: 20 weeks of English (10 weeks free) + Master’s program with a chance to settle in Australia with a 10% scholarship for the entire course and tuition fees of only ~AU$21,000 per year.

Hai can stay for 2 years for study and an additional 3+1 years after graduation.

EMK congratulates Do Thi Ngan Ha on receiving a subclass 500 student visa to complete her studies in Australia!

Although Ngan Ha and her family were concerned for Ha’s not having an English certificate and not being able to provide financial proof, EMK reassured them and helped her enroll in a 20-week English course at NSW GHS before starting her main course at the school.

The family was also pleased with EMK’s advice on a suitable study plan for Ngan Ha’s desire to study abroad early, rather than spending time studying English and high school education in Vietnam. In addition, the courses and school chosen were of good quality and had reasonable tuition fees.

Forming Strong Software Development Teams

From 25, November 2023* (subject to the approval of regulation changes), the Australian Government will be making changes to the Temporary Skill Shortage (TSS) (subclass 482) and

Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme (ENS) (subclass 186) visas to provide a simpler and clearer pathway to permanent residence for TSS visa holders.

The changes will provide employers and holders of TSS visas with more certainty and ensure Australia attracts and retains the skilled workers it needs.​

Temporary Skill Shortage (subclass 482)

From 25 November 2023* the Government plans to remove the limit on the number of Short-term stream TSS visa applications that visa holders can make in Australia.

This change is intended to apply to new TSS visa applications made on or after 25 November 2023. Short term-stream TSS holders with visas expiring before 25 November 2023 will need to travel outside Australia to lodge a third short term-stream TSS application.

Employer Nomination Scheme (subclass 186) Temporary Residence Transition Stream

Changes planned for TRT stream nomination requirements include:

  • allowing employers to nominate holders of all streams of TSS visas (including Short-term and Labour Agreement streams).
  • removing the requirement for nominated occupations for the TRT stream to be assessed against a skilled migration occupation list. The nominated occupation will need to be listed in the Australian and New Zealand Standard Classification of Occupations (ANZSCO) and the nominated worker will need to continue to work in the occupation nominated for their TSS visa(s).
  • reducing the period of time a TSS visa holder must hold their visa and work in their nominated position or occupation to be eligible to be nominated by their employer for the TRT stream to two out of the three years before nomination.

Changes to the TRT stream nomination requirements are intended to apply to new ENS and Regional Sponsored Migration Scheme nomination applications and applications that are yet to be finally determined as at 25 November 2023*.

Changes planned for TRT stream visa application requirements include:

  • updating age exemptions for regional medical practitioner applicants and high income earning applicants aged 45 years and over to allow for a two-year pathway.
  • ending COVID-19 related age exemptions that will become redundant as a result of the two-year pathway.

These changes are the first step in providing more equitable access to PR for all TSS visa holders whilst the government continues work on reforms to the skilled visa programs following the development of the Outline of the Government’s Migration Strategy and in response to the findings of the Review of the Migration System 2023.

TSS Visa to Permanent Residency 

The Department of Home Affairs has set 25 November 2023 for implementing changes to the employer-sponsored permanent residency program. 

Once the ENS reforms have been implemented, short-term Temporary Skill Shortage (TSS) 482 Visa holders will gain access to permanent residency under the 186 Temporary Residence Transition Stream (TRTS) of the ENS visa program. 

  • All Temporary Skill Shortage (TSS) SC 482 visa holders will be eligible for ENS visas sponsored by their employers. 
  • Applicants will need to continue to work in the occupation nominated for their TSS visa(s). 
  • Sponsored visa holders will be eligible for ENS TRT after two years (down from three years) of sponsorship on a TSS by their employer. 
  • Applicants will need to meet all other nomination and visa requirements for the TRT stream of the Employer Nomination Scheme visa. 
  • The limit on Short Term stream TSS visa applications that can be made onshore has also been removed in the interim. 

 

PR pathway for specified 482/457 Visa STSOL holders 

From 1 July 2022 applicants can apply for permanent residency if they are: 

457 visa holders: 

  • (1) A person who on 18 April 2017 held a subclass 457 visa or had a pending 457 visa application that was subsequently granted 

482 visa holders: 

  • (2) Commencing 1 July 2022 if you are a subclass 482 holder and 
  • if you have been in Australia for at least 12 months between 1 February 2020 and 14 December 2021; and 
  • at the time of application, you are employed by an employer actively and lawfully operating a business in Australia. 

 

This new legislation provides a pathway to permanent residency for Subclass 482 visa holders in the short-term stream, regardless of whether their nominated occupation is on the Medium & Long-Term Strategic Skills List (MLTSSL), the Short-Term Skilled Occupation List (STSOL) or the Regional Occupation List (ROL). 

This new legislation is relevant for applications under the following Employer-sponsored programs: 

 

According to the changes, if the applicants have worked for their employer for two of the last three years while holding a 482 visa in the short-term stream, after 1 July 2022, they can apply for 186 permanent residency visas. 

Legislative Instrument Migration (Specified persons and periods of time for regulation 5.19) Instrument (LIN 22/038) 2022 replaces IMMI18/052 which was self-repealed on 18 March 2022. 

This new Instrument provides a pathway to employer sponsored permanent residency for an additional cohort of SC457/482 visa holders through the Temporary Residence Transition stream of the employer nominated/sponsored schemes as announced by Minister Hawke on 25 November 2021. 

After 30 June 2022 a new cohort of ‘specified persons’ will be eligible to be nominated under the TRT stream of the SC 186 and in some cases the RSMSSC 187.
