Requirement

Direct Entry stream:
- You must be under 45 years of age when you apply for this visa
- You must be nominated by an Australian employer and apply for the 186 visa within 6 months of the nomination being approved
- You need to have at least 3 years relevant work experience in your occupation and your occupation must be on the relevant list of eligible skilled occupations
- You must have a suit able skills assessment for the occupation
- You must have at leastCompetent English (IELTS 6.0 or PTE 50)
Labor Agreement stream:
- You must be under 45 years of age when you apply for this visa
- You must be nominated by an Australian employer and apply for the 186 visa within 6 months of the nomination being approved
- You must have been working full-time for your employer on your subclass 482 visa for at least 3 years of the 4 years prior to nominating you for the subclass 186 visa
- You are not required to have a suit able skills assessment but the case officer may ask to support for the visa application
- You must have at leastCompetent English (IELTS 6.0 or PTE 50)
Temporary Residence Transition stream:
- You must be nominated by an Australian employer whose business is actively and lawfully operating in Australia and party to a labour agreement
- You must currently work, or will work, for your employer under a labour agreement

Can visa 186 lead to PR?

The visa 186 is a permanent resident visa. It allows you to stay in Australia indefinitely. It may lead to citizenship.

Can I leave my job after getting a visa 186?

Once your visa 186 is granted, this gives you full residency rights. You have no obligation to stay in your employment for the full two years if you can prove your application was made in good faith, and the employment relationship has broken down.

Can a visa 186 be cancelled?

Your visa can be revoked by the Australian government if you break any of the terms and conditions of your visa.

If my occupation is not on the MLTSSL, can I still apply for the 186 visa?

Yes, if you apply for the 186 visa (direct stream), your occupation. must be on the MLTSSL. Not the STSOL or the State Occupation List. Immigration has identified these occupations on the MLTSSL as most in demand in Aus. There is a short age of skilled workers in these occupations.

Do I need to undertake Labour Market testing for the 186 visa?

Unlike the TSS visa, for the 186 Direct Entry Stream, Labour Market testing is not 100% a requirement. So you don’t need to advertise the position and demonstrate you couldn’t find a suitable Australian to fill the role
